THE HRALTH and Safety Commission (HSC) has published a consultative
document seeking views on the proposals to amend the Heatth and Safety
(Enforcing authority) Regulations 1989 which allocate enforcement
responsibility for the Health and Safety at Work etc Act 1974 between
the Health and Safety Executive (HSE) and Local Authorities (LAs).
The proposed changes will involve:
(i) re-allocation of enforcement responsibility for preschool care
premises from HSE to LAs;
(ii) amendments to the text of the Regulations to clarify ambiguities
and to bring the Regulations into line with practice; and
(iii) the introduction of new administrative procedures and guidance.
The consultative document is also seeking views on the future
allocation of the responsibility for enforcing health and safety
legislation in two sectors of business: motor vehicle repair and
residential care and nursing homes.
The consultative document is free and has been designed so that
details of the proposed changes are clear
The closing date for comments is l4th March l997. HSC hopes that
the amendments will be introduced in the summer of l997
